Liffey Metals: Postal Selling Terms

These terms apply when you send us gold, silver or other precious metal items by post to sell to us. Please read them before you tick the box. They are written in plain English on purpose. Nothing in them affects your statutory rights as a consumer.

1. Who we are

Liffey Metals is a trading name of [LIFFEY METALS LIMITED], a company registered in Ireland, company number [NUMBER], registered office [ADDRESS], VAT number [NUMBER]. In these terms "we", "us" and "our" mean Liffey Metals, and "you" means the person selling items to us.

2. Who can sell to us

2.1 You must be at least 18 years old and live in Ireland.

2.2 You must own the items you send, or be legally authorised to sell them (for example as the executor of an estate). By sending items to us you confirm this.

2.3 You confirm the items are not stolen, not subject to any claim by anyone else, and not the proceeds of crime.

3. What we accept by post

3.1 We accept gold, silver and platinum jewellery, scrap, coins and small items.

3.2 We do not accept by post: bullion bars, cash, items you do not own, silver plate (for example items marked EPNS, EP, A1 or "silver plate"), or items worth more than the postal value limit in clause 6.

3.3 For silver, mixed items, platinum, or anything you are unsure about, please contact us on WhatsApp first. We will tell you whether and how to send it.

3.4 If you send items we do not accept, we will return them to you under clause 10, except where clause 11 applies.

4. Your free pack or label

4.1 We will send you, free of charge, either a prepaid return label by email or a postal pack.

4.2 You do not pay anything upfront, and you are not committed to selling. You can decide not to send anything, and there is no charge.

4.3 Please follow the packing instructions we give you. Do not write "gold", "jewellery" or similar on the outside of the parcel.

5. Postage deduction (please read)

5.1 The pack and the return label are free to you when you receive them.

5.2 If you accept our offer and sell to us, we deduct a fixed postage charge of €12 from your payment. This covers the cost of the return postage we paid. The deduction is shown as a separate line on your offer before you accept.

5.3 If you decline our offer, we do not charge you anything, and we return your items free of charge under clause 10.

5.4 If you do not send anything, you pay nothing.

6. Value limit and risk in the post

6.1 The maximum total value you may send in one parcel is €2,000 (the "postal value limit"), based on the metal value of the items.

6.2 An Post does not insure jewellery or precious metals. We therefore cover the risk ourselves, as follows. If you post your parcel using the label we provided, you keep your proof of postage, and tracking shows the parcel was accepted by the post office but it never reaches us, we will pay you the value of the items you declared on your request form, up to the postal value limit, once we are reasonably satisfied the parcel was lost in the post.

6.3 We are not responsible for items sent without our label, the part of any parcel's value above the postal value limit, or items that were not in the parcel when it was posted.

6.4 Once your parcel has been delivered to us, it is our responsibility until we either pay you for it or return it to you.

7. Receiving and testing your items

7.1 We open every parcel on camera and record what it contains. If what we receive is different from your description, we will tell you.

7.2 We test items using an XRF analyser, which is non-destructive and does not damage your items. We weigh items on calibrated scales.

7.3 If the XRF result is unclear (for example for plated or hollow items), we may carry out a small surface test in an inconspicuous place. We will not melt, cut or otherwise alter your items before you accept our offer.

7.4 We remove and return, or leave in place, any stones, pearls, watch movements and other non-metal parts. We do not pay for gemstones unless we agree otherwise in writing. Stones are returned to you with your payment confirmation, or on request.

8. Our offer

8.1 Our offer is based on the weight and purity of the precious metal in your items and our published buy price for that metal at the time we make the offer.

8.2 The prices on our website are indicative and change with the market. Your offer is confirmed only when we send it to you.

8.3 Your offer shows: each item or group of items, the metal and purity found, the weight, the price, the postage deduction under clause 5, and the net amount we will pay you.

8.4 An offer is valid for 48 hours from the time we send it. After that we may re-price it at the current market price.

8.5 You can accept or decline your offer by the link in our email, by email, or on WhatsApp.

9. Payment

9.1 Before we pay you, you must verify your identity with photo ID and provide a bank account in your own name. This is required by Irish anti-money-laundering law.

9.2 The name and address on your ID must match your request. If they do not, we will not pay until the difference is resolved.

9.3 We pay by bank transfer only, normally on the same working day you accept, and in any case within [2] working days after we receive your ID and bank details.

9.4 Ownership of the items passes to us when we make the payment.

10. Returning items

10.1 If you decline our offer, or we cannot accept the items, we will return them to the address on your request free of charge, by tracked post.

10.2 If you do not accept or decline an offer within [30] days, and we cannot reach you by email or WhatsApp, we will return the items to the address on your request.

10.3 If returned items cannot be delivered and are sent back to us, we will hold them for [6 months] and keep trying to contact you. After that, we may deal with them as the law allows.

11. Legal checks and suspicious items

11.1 We may ask where the items came from, and may refuse any sale without giving a reason.

11.2 If we have reason to believe items are stolen or linked to crime, we may hold them and report the matter to An Garda Síochána or other authorities, as the law requires. In that case we may not be able to return the items to you or tell you about the report.

11.3 Items that turn out to be fake or plated are returned to you under clause 10, unless clause 11.2 applies.

12. Our liability

12.1 We take reasonable care of your items while they are with us.

12.2 Our total liability to you for any item is limited to the metal value of that item as set out in our offer or, if no offer was made, the value you declared, up to the postal value limit. This does not limit liability that cannot be limited by law.

13. Your personal data

We collect your details, ID and bank information to process your sale and to meet our legal obligations, including anti-money-laundering record keeping. We keep these records for as long as the law requires. See our Privacy Policy at liffeymetals.com/privacy for full details and your rights.

14. Complaints

If you are unhappy with anything, contact us at andrew@liffeymetals.com or on WhatsApp. We will reply within [5] working days and try to put it right.

15. Changes to these terms

We may update these terms. The version you accepted when you requested your pack or label applies to that sale.

16. Law

These terms are governed by Irish law, and the Irish courts have jurisdiction.
